CALIFORNIA SMOKE PHOTOGRAPHY
SERVICE CONTRACT
II. TERM
The term of this agreement shall commence on the agreed upon day of the shoot, and end at the end of the photography session and respectfully to when the edited images and final gallery are delivered to the client.
LIABILITY AGREEMENTS ARE INDEFINATE
I. THE SERVICE
The Photographer agrees to provide the following:
-MINI ELITE. (1 look, 5 images, 30 mins). (Not available on travel shoots, conditions apply. Please review webpage description.)
-SILVER sMOKE (2 looks, 10 images, 45-60 mins).
-GOLD SMOKE (3 looks, 15 images, 60-75 mins).
-DIAMOND SMOKE (5 looks. 30 images, 100 mins).
Hereinafter known as the "Service". Photographer shall provide, while providing the service, that he/she/they shall comply with the policies, standards, and regulations of the client, including local, provincial, and federal laws and to the best of their abilities.
IV. PAYMENT AMOUNT
The Client agrees to pay the photographer the following compensation for the service performed under this agreement:
$225.00 MINI ELITE
$350.00 SILVER SMOKE
$450.00 GOLD SMOKE
$700.00 DIAMOND SMOKE
RESCHEDULING FEE. Upon booking and confirming a date and time for a photo shoot with contract and retainer, if any changes need to be made to the booked date and time the client must understand that there is a $75.00 rescheduling fee. Our time is important, and scheduling can be a fickle thing as it is. Let's do our best to maintain the original booked date and time to avoid the rescheduling fee. Thanks for understanding this.
V. PAYMENT METHOD/RETAINER
Retainer. The Client is to pay a retainer in the amount of $150.00 to the photographer as an advance on future services to be provided.
Please note that the retainer is NON REFUNDABLE under any circumstances.
CANCELLATION/ CHANGE
The retainer can be transferred to a different shoot with the same client if 72 hours notice was given to cancel or move the shoot OR emergency situations arise prior to shoot. Please note. failure to show up to the shoot or cancellation without emergent situation within 72 hours of shoot will result in a total loss of the paid retainer.
To confirm the movement of the deposit, the rescheduled shoot must be booked and confirmed for the new date/time. Failure to pick a new date will also result in full loss of retainer.
VI. INSPECTION OF SERVICES
If any of the services performed by the photographer pursuant to this agreement are
defective or incomplete, the client shall have the right to notify the photographer, at which time the photographer shall promptly correct such work within a reasonable time. It is the clients responsibility to investigate California Smoke's instagram, facebook, and webpage gallery to visualize and understand the theme and art as to how to photos are shot and edited. Client is to understand that their package will be similar to the style presented on California Smoke's social media AND online gallery, if any specific editing is requested it is to be communicated before the shoot. CSP (California Smoke Photography) retouches facial areas and corrects skin texture, clarity and lighting. If less retouching and a more natural image is requested please notify the photographer at the end of the photo shoot session and before any images are retouched.
VII. TIME IS OF THE ESSENCE
Photographer acknowledges that time is of the essence in regard to the performance of all services. The photographer agrees to have all edited images returned to the client within a maximum of 60 days from the shoot. Typical turn around time is less than 14 days for me, the 60 day maximum is worst case scenario!
The photographer will pick the clients selected images. We are so used to our own features that we do not realize what traits or angles are aesthetically pleasing to other eyes. Having a new eye picking your most beautiful angles helps add diversity to your images. If the client wants to pick their own images, please alert me before booking as this is an extra service. Please refer to the website for the pricing regarding this.
VERY IMPORTANT!!!!!!!!! The photographer may not store the clients photos for more than 10 days after images are delivered so the responsibility to save all images delivered is solely the clients.
VIll. CONFIDENTIALITY
Photographer shall not, during the term of this agreement or after its termination, disclose any confidential Information for the benefit of the photographer or any other person, except with the prior written consent of the client. The photographer will not post or share any images on social media without the consent of the client. If the client agrees that the pictures are appropriate and flattering. that agrees to a photo release between client and photographer which may be verbal, or written consent, or text . The client must obtain consent from the photographer to submit to any magazines, webpages, contests etc. to ensure accreditation to California Smoke Photography is done accurately.
NUDITY: California Smoke Photography acknowledges the sensitive nature of nude photography. This is important especially for boudoir sessions, as you can be in full nude if you desire. Please feel free to communicate anything that will make this process more comfortable for you.
X. MODIFYING AND POSTING IMAGES
The images belong to California Smoke Photography. The client shall not apply filters, crop, or modify the supplied image in any way. Please fit the image to size on instagram and do not post it in a square as it will ruin the composition of the photo

XI. LIABILITY
This Agreement constitutes the entire agreement between the Parties to its subject matter and supersedes all prior contemporaneous agreements, representations, and understandings of the parties.
The client acknowledges and assumes all risk for injury, illness, and disability in regards to the photoshoot and photoshoot locations. The client understands that the photoshoots are done in sometimes dangerous (falls, trips, scrapes, accidents) or public areas and does not hold California Smoke Photography responsible for any incidents that may arise.
The client understands the risks associated with public and exposure to COVID-19 and does not hold California Smoke Photography liable.
The client may not pursue the photographer in any legal way with regard to images and services rendered as per this contract. No supplement, modification. or amendment of this agreement shall be binding unless executed in writing by all parties.
